Rental Terms and Conditions
1. Check-In / Check-Out Times
Check-in time is 4:00 PM (HST). Check-out time is 11:00 AM (HST). Early check-in and/or Late check-out require special arrangements, and may be subject to an additional fee. Refunds will not be given for late arrivals or early departures.
2. Gaining Access to the Property
In most cases, our Luxury Rentals Oahu Guest Concierge will greet you at the property, give a brief tour of the property and its facilities, familiarize you with how things work and answer any questions you may have. Within 10 days of check-in, the primary Guest will receive an email with arrival instructions containing all important information needed to locate and access the property.
3. Reservation Deposit
In order to confirm a reservation, a non-refundable $300 deposit is due at time of booking. The $300 deposit will be applied towards the remaining balance 60 days prior to check-in.
4. Payment of RentThe balance of the rental fee is due 60 days prior to the check-in date. We accept electronic checks and credit cards (Master Card, Visa, Discover and American Express).
Current rates for General Excise Tax and Transient Accommodations Tax will be charged to the Renter. These taxes will be quoted to the Renter at time of booking.
6. Cancellations and Changes
Cancellation requests must be emailed and confirmed by Luxury Rentals Oahu (firstname.lastname@example.org) at least 60 calendar days prior to your arrival date ("Cancellation Period"). In such instances, the non-refundable $300 Reservation Deposit will be held as an administrative cancellation fee. In the event of cancellations made after the Cancellation Period, guest will be responsible for the full amount of the total booking charges. Luxury Rentals Oahu will not issue refunds for cancellations or shortened stays due to actual or anticipated hurricanes, tropical storms or other inclement weather under any circumstances. For this reason, we strongly recommend purchasing Travel Protection.
7. Travel Protection/Travel Insurance
CSA Travel Protection has been made available with your reservation. Travel Protection provides coverage for prepaid, nonrefundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. Luxury Rentals Oahu strongly recommends you purchase this valuable protection. Separate terms and conditions apply, read your Description of Coverage/Policy carefully and contact CSA at (866) 999-4018 with coverage questions.
Guests who choose to decline the purchase of Travel Protection acknowledge to have read, understand and agree to accept the terms of our Cancellation Policy.
8. Hurricanes and Severe Weather
Trip Cancellation and Trip Interruption Coverage is available for events such as flight delays due to adverse weather; interruptions of road service; and mandatory evacuations. The plan also includes other valuable coverages including Travel Delay and Emergency Assistance and Transportation in addition to 24/7/365 emergency assistance services. We strongly recommend you purchase this valuable protection. 9. Accommodation Selections
Luxury Rentals Oahu will reserve the specific unit selected at the time of your reservation upon the receipt of your deposit and signed contract. If the selected property becomes unavailable for unexpected maintenance, or any issues beyond the control of Luxury Rentals Oahu that may render the property unsuitable for rental at the time of stay, guests will be provided with a full refund or an opportunity to stay in a similarly priced property if available. In no event will Luxury Rentals Oahu be responsible for any direct or indirect costs, expenses, fees or other consequential damages resulting from the unavailability of a specific property.
10. No Pets
Pets are ONLY permitted in designated Luxury Rentals Oahu properties. Management must approve all pets and a pet fee will be added to reservations at properties that are Pet Friendly. Guests who violate this policy will be charged an additional $500 fine, plus the expense of any necessary cleaning. Violations may also result in immediate eviction and forfeiture of rent.
11. No Smoking
Smoking is NOT permitted in any property managed by Luxury Rentals Oahu. Guests understand and agree that NO SMOKING is allowed inside the unit and/or balconies during their stay. Guests who violate this policy will be charged an additional $500 fine plus the expense of any damages caused to the property by cigarettes and/or cigarette smoke. Violations may also result in immediate eviction and forfeiture of rent.
12. Minimum Booking Requirements
All of our properties require a minimum booking of thirty (30) nights.
13. Maximum Number of Guests
Every property has a maximum occupancy based on the individual property’s ability to comfortably and safely house our guests as indicated on each unit description, which cannot be exceeded. Maximum occupancy violations may result in immediate eviction and forfeiture of rent.
14. Age Requirements
No property will be rented to vacationing students or young adults under the age of 21. The primary guest must be a responsible adult and is required to occupy the property during the entire length of stay and is solely responsible for their actions and the actions of their guests. Guest who violate this policy are subject to immediate eviction and forfeiture of rent.
All stays are subject to a cleaning fee. Your property will be professionally cleaned prior to your arrival and after your departure. Guests will be responsible for maintaining the unit during their stay and for leaving the unit in a well-kept condition upon check-out. If units are found excessively unkept at check-out, additional cleaning fees may apply. Your property will have an initial supply of trash liners, paper towels, dish soap, toilet paper, bath soap, etc. Once you have used these amenities you will need to purchase additional supplies to last the remainder of your stay. Additional cleanings during your stay can be requested and arranged for an additional fee.
During your stay, promptly report any maintenance issues to Luxury Rentals Oahu, allowing us to promptly inspect and remedy the problem. No refund or rent adjustment will be made for any unforeseen interruption in the supply of electricity, water, air conditioning, telephone, television, cable service, appliances, etc. Luxury Rentals Oahu cannot be held responsible for any inconvenience due to maintenance, construction or construction noise beyond the property. No refunds or relocation will be given due to these issues.
17. Right to Enter
When required, a Luxury Rentals Oahu Guest Concierge, or their designated vendors may enter the property to inspect or make necessary or requested repairs. Luxury Rentals Oahu will give guests a minimum of 8-hour notice before entering the property and will only enter during reasonable hours, except in the case of emergency.
18. Damage Policy
Guests are responsible for the property and its contents during their stay. Guests agree to secure windows and doors when not on the premises and prior to check-out. Rearranging furniture or removal of any property from the unit is strictly prohibited. After Check-out, Luxury Rentals Oahu will inspect the unit for damage, missing items, and excessive wear and tear. If it is determined that damage is present or items are missing, Luxury Rentals Oahu will repair the damage and/or replace the missing items from the unit at Guest’s expense. Guest authorizes Luxury Rentals Oahu to charge the credit card on file to reimburse for any such expenses incurred.
19. Damage Deposit
Depending on the property reserved, a $3,000-$5000 Accidental Damage deposit will be placed on the credit card on file 10 days prior to arrival. If your stay is accident free, your deposit will be released within 10 days of your departure. Guest authorizes Luxury Rentals Oahu to charge the credit card on file to reimburse for any such expenses incurred over the required deposit. As an alternative, we strongly recommend purchasing Vacation Rental Damage Protection.
20. Vacation Rental Damage Protection
As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit up to the policy limit shown on the confirmation $69 for $3,000 or $99 for $5,000 protection based on property reserved. Any damages that exceed the policy limit or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of the policy limit. Certain terms and conditions apply. Full details of the Vacation Rental Damage Protection coverage are contained in the Description of Coverage or Insurance Policy www.vacationrentalinsurance.com/g20vrd. The Vacation Rental Damage Protection plan can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request CSA Travel Protection and Insurance Services to pay directly Luxury Rentals Oahu any amount payable under the terms and conditions of the Accidental Damage Protection. Please contact Luxury Rentals Oahu directly if you do not wish to participate in this assignment.
If you wish to decline this coverage you may do so, however a $3,000-$5,000 damage deposit will be placed on the credit card on file 10 days prior to arrival. Should your stay be accident free, your deposit will be released within 10 days of your departure.
21. Security of Personal Property
Luxury Rentals Oahu is not responsible for any acts of theft or vandalism, or other damages to any personal property or for personal items left by guests at departure.
22. No Subletting
The rental property may not be sublet for any portion of your stay and is not transferable to another party.
23. Noise Policy
Noise levels should be kept to a minimum between 10pm to 8am. Excessive noise complaints may result in immediate eviction and forfeiture of rent.
24. Property Rules and Regulations
Please observe all House Rules and regulations governing the use of the property you are occupying. These rules apply to both Renter and their guests. Failure to comply can result in eviction and forfeiture of rent.
25. Acceptance of Terms and Conditions
By placing a reservation request with Luxury Rentals Oahu, Renter acknowledges to have read, understand and agree to all Terms and Conditions including, without limitation, the Cancellation Policy. Renter agrees to abide by all House, Owner’s Association, and other Rules and regulations applicable to the property, as well as all Terms and Conditions of this Agreement. Renter understands that Luxury Rentals Oahu is an agent for the property owner. Renter further understands and agrees to explain the Terms and Conditions to all guests in their group who are authorized to stay at the property prior to their arrival. Renter executes this Agreement on behalf of all individuals in their group, who agree to be bound by the Terms and Conditions set forth herein.
Guest agrees to indemnify, hold harmless and defend Luxury Rentals Oahu, Inc. and Owner of the Property from and against all claims, demands, damages, disputes, litigation, judgments, losses, liabilities, causes of action, cost or expenses (including reasonable attorneys’ fees) or claims arising out of or connected with any loss, damage to others, bodily injury, personal property damage, personal injury occurring on or about the premises to Guest and their guests’. Luxury Rentals Oahu, Inc. and Owner of the Property are not responsible for lost, stolen, or misplaced items, vandalism, acts of God, inclement weather conditions, or accidents related to fire.
